Without limiting any of those representations or warranties, SendReceived.com has the right (though not the obligation) to, in SendReceived.com’s sole discretion (i) refuse or remove any content that, in SendReceived.com’s reasonable opinion, violates any SendReceived.com policy or is in any way harmful or objectionable, or (ii) terminate or deny access to and use of the Website to any individual or entity for any reason, in SendReceived.com’s sole discretion.

SendReceived.com will have no obligation to provide a refund of any amounts previously paid.

1. Responsibility for Conduct.
   1. You agree that you are solely responsible for your actions and the content of your transmissions via the Site.
       
2. No Illegal or Deceptive Acts.
    You agree:
   1. to abide by all applicable local, state, national, and international laws and regulations in your use of the Site;
   2. not to impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity;
   3. to comply with all laws regarding the transmission of data (including without limitation encryption) through the Site;
   4. not to use the Site for illegal purposes;
   5. to comply with all regulations, policies and procedures of networks connected to the Site; and not to use the Site to collect or harvest personal information, including, without limitation, financial information, about other Members or the Site.
       
3. Libelous or Scandalous Materials.
       You agree:
   1. not to post, promote or transmit through the Site any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, hateful, racially, ethnically or otherwise objectionable material of any kind or nature;
   2. not to transmit or post any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national or international law or regulation;
   3. not to interfere with another Member's use and enjoyment of the Site or another entity's use and enjoyment of similar Sites, or engage in surveys, contests, chain letters or post or transmit "junk mail", "spam", "chain letters", or unsolicited mass distribution of e-mail; and
   4. that SendReceived.com neither endorses the content of any Member communications, postings or data nor assumes any responsibility for any threatening, libellous, obscene, harassing or offensive material contained in such materials, or any crime facilitated by use of this Web site.
       
4. System integrity.
      You agree:
   1. not to upload or distribute in any way files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer;
   2. not to interfere or disrupt networks connected to the Site;
   3. not to use any device, software or routine or attempt to interfere with the proper functioning of the SendReceived.com site or any transactions being offered at this Web site;
   4. not to take any action that imposes an unreasonable or disproportionately large load on SendReceive’s infrastructure; and
   5. not to disclose Member's Password to third parties or use Member's Password for any unauthorized purpose.
       
5. Refund Policy
   SendReceived.com offers you a free trial to help you understand how the product performs. Clients are encouraged to take a close look at all features presented prior to purchasing, in order to have a good idea about the product's capabilities. Complete online documentation (FAQ and pricing) is available on the service, so that you can fully discover the features of the services before purchasing. Once you have purchased the product both online (FAQ) and email support is available for you to resolve any issue. As a result, SendReceived will have no obligatiion to provide a Refund for amounts previously paid. Any refunds will be given at the sole discretion of the Company Management.
    
6. Fees and Payment.
   1. All subscription fees, are payable in advance in U.S. Dollars. As a subscriber to the Online Services, you agree that we are permitted to charge your credit card for your applicable subscription fee and any other charges you may incur in connection with your use of the Online Services. The subscription fee will be billed at the beginning of your subscription and for Subscribe Customers on each renewal thereafter unless and until you terminate your subscription as provided herein.
   2. For Subscribed Customers: your subscription for the Online Services will be automatically renewed on the applicable period (nominally monthly - 30 days) as applicable. For your convenience, SendReceived.com will charge your applicable subscription fee to the credit card you provide during registration. Your subscription will automatically renew for successive periods as applicable without prior notice to you, unless and until your subscription is terminated. You must terminate your subscription before it renews in order to avoid billing of subscription fees to your credit card.
   3. All charges to you are exclusive of any state or local sales, use, or similar taxes. If any such taxes are applicable, they shall be your responsibility.
   4. SendReceived.com does not guarantee that the Online Services and Materials will operate continuously or be error-free. You hereby acknowledge and agree that all sales and charges are final and shall not be subject to refund, dispute or chargeback for any reason.
       
7. Fraud.
   SendReceived takes any incidents associated with Fraud very seriously. This includes Credit Card Fraud. Such incidents will be investigated and reported to appropriate Authorities as soon as they are discovered.
    
8. Copyright Infringement and DMCA Policy.
   As SendReceived.com asks others to respect its intellectual property rights, it respects the intellectual property rights of others. If you believe that material located on or linked to by SendReceived.com violates your copyright, you are encouraged to notify SendReceived.com in accordance with the Digital Millennium Copyright Act .SendReceived.com will respond to all such notices, including as required or appropriate by removing the infringing material or disabling all links to the infringing material. In the case of a visitor who may infringe or repeatedly infringes the copyrights or other intellectual property rights of SendReceived.com or others, SendReceived.com may, in its discretion, terminate or deny access to and use of the Website. In the case of such termination, SendReceived.com will have no obligation to provide a refund of any amounts previously paid to SendReceived.com.
    
9. Intellectual Property.
   This Agreement does not transfer from SendReceived.com to you any SendReceived.com or third party intellectual property, and all right, title and interest in and to such property will remain (as between the parties) solely with SendReceived.com. SendReceived.com, the SendReceived.com logo, and all other trademarks, service marks, graphics and logos used in connection with SendReceived.com, or the Website are trademarks or registered trademarks of SendReceived.com or SendReceived.com’s licensees. Other trademarks, service marks, graphics and logos used in connection with the Website may be the trademarks of other third parties. Your use of the Website grants you no right or license to reproduce or otherwise use any SendReceived.com or third-party trademarks.
    
10. Privacy Policy
    All electronic mail messages sent using the Online Services are confidential in accordance with generally accepted standards of electronic mail usage.
     
11. Changes.
    SendReceived.com reserves the right, at its sole discretion, to modify or replace any part of this Agreement. It is your responsibility to check this Agreement periodically for changes. Your continued use of or access to the Website following the posting of any changes to this Agreement constitutes acceptance of those changes. SendReceived.com may also, in the future, offer new services and/or features through the Website (including, the release of new tools and resources). Such new features and/or services shall be subject to the terms and conditions of this Agreement.
     
12. Termination.
    SendReceived.com may terminate your access to all or any part of the Website at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate this Agreement or your SendReceived.com account (if you have one), you may simply discontinue using the Website. All provisions of this Agreement shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
     
13. Disclaimer of Warranties.
    The Website is provided “as is”. SendReceived.com and its suppliers and licensees hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither SendReceived.com nor its suppliers and licensees, makes any warranty that the Website will be error free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, the Website at your own discretion and risk.
     
14. Limitation of Liability.
    In no event will SendReceived.com, or its suppliers or licensees, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement or substitute products or services; (iii) for interruption of use or loss or corruption of data; or (iv) for any amounts that exceed the fees paid by you to SendReceived.com under this agreement during the twelve (12) month period prior to the cause of action. SendReceived.com shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.
     
15. General Representation and Warranty.
    You represent and warrant that (i) your use of the Website will be in strict accordance with the SendReceived.com Privacy Policy, with this Agreement and with all applicable laws and regulations (including without limitation any local laws or regulations in your country, state, city, or other governmental area, regarding online conduct and acceptable content, and including all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside) and (ii) your use of the Website will not infringe or misappropriate the intellectual property rights of any third party.
     
16. Indemnification.
    You agree to indemnify and hold harmless SendReceived.com, its contractors, and its licensees, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of the Website, including but not limited to out of your violation this Agreement.
     
17. Miscellaneous.
    This Agreement constitutes the entire agreement between SendReceived.com and you concerning the subject matter hereof, and they may only be modified by a written amendment signed by an authorized executive of SendReceived.com, or by the posting by SendReceived.com of a revised version. Except to the extent applicable law, if any, provides otherwise, this Agreement, any access to or use of the Website will be governed by appropriate state or country laws., excluding its conflict of law provisions, and the proper venue for any disputes arising out of or relating to any of the same will be the appropriate state and federal courts. SendReceived.com may assign its rights under this Agreement without condition. This Agreement will be binding upon and will inure to the benefit of the parties, their successors and permitted assigns.
